Q. Do I have a personal injury case?

Q. How do your fees work?

A. All consultations are free. The legal fee for personal injury matters is taken on a contingency basis. This means that there is no legal fee unless there is a recovery in your case. Generally, the firm pays for the expenses of the case up front, and is reimbursed by the client at the conclusion of the case. Any applicable legal fee is computed after disbursements. Q. Can I file a lawsuit if I was injured on the job?

A. If a third party other than your employer or a co-worker in any way caused the accident, you may be able to bring a lawsuit, even if you are already collecting Workers' Compensation or disability benefits. The entity paying the benefits may be entitled to a lien. In many situations, however, a qualified personal injury attorney can negotiate a reduction in the lien or have it eliminated completely. Q. I'm not happy with my current attorney. Can I change attorneys? Will I have to pay additional legal fees?

Your current attorney may be entitled to a legal fee for the services rendered up until the time of dismissal. If there is a contingency fee situation, such as in the standard personal injury matter, there is no additional fee charged to you. Your current attorney and the new attorney usually work out the sharing of the fee themselves, based on the work each performs. If they cannot agree, a judge will step in to make the decision.


Q. I was involved in a hit-and-run accident and sustained serious injuries. Can I still recover money?

A. You may be able to recover money through the Uninsured Motorist coverage of the relevant insurance policy or the New York State Motor Vehicle Accident Indemnification Corporation. Q. If I bring a lawsuit, will I have to go to court?

A. Most cases settle before trial. Settlement occurs after the attorney has successfully negotiated and the client agrees to the offered amount.
